Welcome to Jordan’s Library – Quarter 4 Contest and Sweepstakes (each defined by separate prizes as detailed below and hereinafter referred to as the “Contest” or “Sweepstakes” respectively). This Contest and Sweepstakes is hosted by Bowny LLC. (“Sponsor”) and provides participants with the exciting opportunity to earn entries for a chance to win valuable prizes. To ensure a fair and enjoyable experience for all participants, it is crucial to understand and abide by the following detailed Terms and Conditions.
To be eligible to participate in the Contest/Sweepstakes, participants must meet the following criteria:
3.1. Free Method of Entry: To earn a single entry into the Contest, participants are required to join Jordan’s Library community group as a ‘T2 member’ or ‘OG member’ and must opt in for the December Challenge. A 7-day free trial is offered for joining the community group.
3.2. Entries: Entries must be manually key-stroked by the entrant; the use of automated entry devices or programs, or entries by third parties, is prohibited. Entries that do not conform to or that violate these Terms, or are submitted in any manner other than as stated herein, will be disqualified. Proof of submission of an entry does not constitute proof of receipt of the same. By entering this Sweepstakes, participants agree to these Terms and the decisions of the Sponsor, which are binding and final in all matters relating to this Sweepstakes. The Sweepstakes is available to millions of internet users. Odds of winning depend on the total number of eligible entries received during the Entry Period.

4.1. Affiliate Link: To qualify for entry into the Contest, participants must use the specified affiliate links provided by Jordan’s Library, which include Loox, Debutify, and AutoDS. Participants are required to register for these services using the same email address with which they registered for the community group on Whop. This ensures eligibility for additional entries in the Sweepstakes. Participants may also choose to use additional tools, applications, and services, along with other third-party Shopify apps, to manage, enhance, and optimize their stores.

Use the links through Jordan’s Library to create a new Shopify store, Auto ds, Debutify, Loox Generate and fulfill as many orders as you can through your Shopify account and submit the total Sales results at the end of the month.
By completing EACH of the above steps, an Entrant will obtain one (1) Contest entry. Limit one (1) Contest entry per Entrant per Submission Period. NOTE: A Shopify, Auto ds, Debutify and Loox account must be new as of a Submission Period start dateAll accounts created before the start date of a Submission Period will not qualify.
7.1. Data Collection: All personal information collected from participants during the Contest/Sweepstakes will be treated in accordance with applicable data privacy laws and regulations. This information may include, but is not limited to, names, email addresses, and contact information.
7.2. Data Usage: Jordan’s Library will collect and use this information solely for Contest/Sweepstakes -related communications and prize distribution. Jordan’s Library will not share or sell participant information to third parties unless required by law.

Jordan’s Library reserves the right to disqualify any participant who violates these Terms and Conditions or engages in fraudulent or inappropriate conduct, as determined solely by Jordan’s Library. Disqualified participants will forfeit any earned entries and any potential prizes.
In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the Address is registered. Entries by any method other than set forth above in Section 3 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Terms; or for lost, interrupted or unavailable network, server, Internet Service Provider, Website or other connections; telephone availability or accessibility; miscommunications; failed computer, satellite, telephone or cable transmissions, lines or technical failure; failed phone, computer hardware or software, failures, technical errors or difficulties; telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant’s email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified and any attempt by a person to use multiple email accounts to register more Entries than allowed by these Rules may result in disqualification at Sponsor/ sole discretion. Void in Quebec and wherever else prohibited and subject to all applicable federal, state, provincial, territorial, local and municipal laws and regulations.
10.1. Allowable Countries: This Contest/Sweepstakes is only open to residents of the following countries or regions (non-exhaustive list):

Legal Responsibility: It is the sole responsibility of participants to ensure their eligibility to participate in the Contest/Sweepstakes according to these Terms as well as the laws of their country or jurisdiction. Jordan’s Library is not responsible for any legal consequences arising from participation in regions where such participation is restricted or prohibited.
Participants represent and warrant that their submitted entry is the original work of the Entrant, has not been previously published, has not won previous awards, and does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity and must have been created in a legal and safe manner. If the entry contains any material or elements that are not owned by the Entrant or provided by the Sponsor, and/or are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who appears in or is identifiable in the entry (collectively, the “Clearances”). By submitting an entry, an Entrant warrants and represents that he or she consents to the submission and use of the entry in the Contest/Sweepstakes.
Entries may not contain any image or depiction of the following: (i) materials which include or constitute trademarks, trade names or copyrighted works created or owned by any person or entity other than Entrant or for which the Entrant has obtained owner’s written permission to use (Sponsor’s discretion); (ii) materials bearing profanities, or bearing the name or likeness of any celebrity, living or dead; (iii) materials which contain visible identifiable or potentially identifiable information, including but not limited to, phone numbers, website links, street addresses, e-mail addresses or license plate numbers; (iv) inappropriate behavior for a general audience; (v) any depiction of real or simulated sexual acts; (vi) violence in any form; (vi) materials which violate anyone’s reasonable privacy expectations, violate any known agreement, or which are defamatory in nature; (viii) materials which are derogatory to Sponsor, or any affiliated entity or person; (ix) materials which are discriminatory based on race, religion, national origin, physical disability, age, sex, or sexual orientation or preference; (x) materials in which any person identifiably appears unless Entrant has obtained an appropriate written release from such person granting all rights required herein; and, (xi) materials which do not comply with all other requirements in these Official Rules. Entries that do not conform to these guidelines will be disqualified. Sponsor reserves the right to reject or disqualify any entry which Sponsor, in its sole and absolute discretion, determines to be inconsistent with the letter or spirit of the Official Rules or potentially damaging to its, the Contest/Sweepstake’s, or another’s image or reputation.
11.1 SWEEPSTAKES TERMS & CONDITIONS
11.2 Prize Structure: The Sweepstakes will award a total of thirty (30) prizes, each consisting of $1,000 USD, throughout the month of December.
11.3 Selection of Winners: Winners will be selected in four phases, with each phase covering a specific date range in December. The schedule for the selection of winners is as follows:

11.6 Grand Prize: The Contest will award a Grand Prize of $10,000 USD.
11.7 Eligibility for Grand Prize: The winner of the Grand Prize will be the participant who earns the highest revenue in their Shopify store for the month of December, using our specified codes. The store must be a new setup.
11.8 Revenue Collection Date: The revenue calculation cutoff is December 31st at 11:59 PM MST.
11.9 Announcement of Grand Prize Winner: The winner of the Grand Prize will be announced on January 15th at 4:00 PM MST.
* All taxes are solely the responsibility of each Winner, who (except for any Canadian) will receive an IRS Form 1099 reflecting the value of his/her Prize.
Jordan’s Library reserves the right to select an alternate winner or modify the prize if, for any reason, a prize cannot be awarded as planned. This provision ensures that the Contest/Sweepstakes remains fair and enjoyable.
13.1. Selection Process: Winners will be randomly selected from the registered participants. Each Canadian resident who is a potential Winner will be required to answer correctly a mathematical skill testing question without assistance of any kind whether mechanical or otherwise to be declared a Winner and be eligible to collect the Prize.
13.2. Notification: Winners will be notified via email within seven (7) days of the drawing. Each winner must respond to the notification within the specified time frame to claim their prize.
13.3 Alternate Winners: At the sole discretion of the Sponsor, disqualification or forfeiture – the selection of an alternate Winner may result from any of the following: [a] potential Winner’s failure to respond to notification within seven (7) days after transmission; [b] the return of an email notification as undeliverable after three (3) attempts; [c] the return of any other notification as undeliverable; [d] potential Winner’s failure to provide Sponsor with satisfactory proof of age, identity and residency; [e] potential Winner’s failure to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the Address associated with the winning Entry; [f] potential Winner’s failure to provide required additional information upon Sponsor’s request for eligibility, Prize fulfillment or Prize tax reporting purposes; [g] potential Winner’s failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release (if a US resident) or a Declaration of Eligibility, Release of Liability and Publicity Release (if a Canadian resident) (collectively, “Declaration/Release”) within five (5) business days (if a US resident) or within ten (10) business days (if a Canadian resident) after its mailing;; and [i] any other non-compliance with Rules. In the event of any Prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited Prize to an alternate winner, time permitting, except as otherwise required by law.
The Contest/Sweepstakes will run from December 1st 2023 to December 31st 2023, ending at precisely 11:59:00 PM Mountain Time. Participants are encouraged to take note of the Contest/Sweepstakes period and time zone. Sponsor’s computer is the official time-keeping device for the Sweepstakes.
15.1. Waiver of Claims: By participating in the Contest/Sweepstakes, participants agree to waive their right to bring any legal claims or actions against Jordan’s Library, its affiliates, employees, agents, or representatives arising from or related to the Contest/Sweepstakes.
15.2. Additional Legal Provisions: Participants further acknowledge that the Contest/Sweepstakes is offered as a promotional event and entertainment activity. They bear full responsibility for their actions and any consequences thereof. Additional legal provisions may apply (details available upon request).
By entering these Sweepstakes and/or accepting any Prize you may win, you agree that: [a] you have all rights, permissions and consents necessary to grant the rights to Sponsor as expressed herein; [b] you will abide by and be bound by these Terms of Use and the Sponsor’s decisions, which shall be final and binding in all respects, and Sponsor’s Privacy Policy (available at https://jordanslibrary.com/privacy-policy/ ); [c] the Entry becomes solely the Sponsor’s property and will not be acknowledged or returned; [d] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any Prize; participation in these Sweepstakes or any Sweepstakes-related activity or from any interaction with, or downloading of, computer Sweepstakes information; [e] the Releasees do not make any representation, warranty or guarantee, express or implied, relating to these Sweepstakes or the Prizes; [f] any Winner’s acceptance of any Prize constitutes the grant to Sponsor and assigns of an unconditional right to use Winner’s name, address (city and state, province or territory only), voice, likeness, photograph, biographical and Prize information and/or statements about these Sweepstakes for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [g] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of these Sweepstakes, so that they cannot be conducted as originally planned, except where prohibited by law, Sponsor has the right, in their sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select Winners by such method as Sponsor in their sole discretion shall consider equitable [h] the Releasees are not responsible for typographical or other errors in the offer or administration of the Sweepstakes, including but not limited to: errors in the advertising, Rules, selection and announcement of the Winners and distribution of the Prizes; [i] any portion of the Prize not accepted or used by any Winner will be forfeited; [j] the Releasees are not responsible for any inability of any Winner to accept or use Prize (or any portion thereof) for any reason; [k] the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following:
[l] Sponsor has the right to lock out an entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the Sweepstakes; [m] since any attempt by any individual to damage the Website or undermine the legitimate operation of the Sweepstakes or the Website is a violation of these Rules as well as criminal and civil laws, and should Sponsor believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution; and [n] Sponsor has the right to modify Prize award procedures at its sole discretion.
16.1. Applicable Law: All disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to these Sweepstakes, the meaning or interpretation of the Rules or any Prize awarded shall be resolved by applying the laws of Utah, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state
16.2. Exclusive Jurisdiction: Participants consent to the exclusive jurisdiction of the state and federal courts located within the state of Utah for any disputes arising from or related to the Contest/Sweepstakes.
16.3 Single Claims: All Claims shall be resolved individually, without resort to any form of class action and all Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event include attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and waives all rights to have damages multiplied or otherwise increased;
This Contest/Sweepstakes is not affiliated with or endorsed by Facebook, Instagram, Discord, or any other social media platform. Participants agree to abide by the terms and conditions of these platforms while participating in the Contest/Sweepstakes.
Jordan’s Library reserves the right to modify these Terms and Conditions at any time without prior notice. Participants are encouraged to review these Terms and Conditions regularly for updates.
These Terms and Conditions may be edited, revised, or updated by Jordan’s Library at its sole discretion as described above. Participants are advised to periodically check for any changes.
Participants agree that any legal actions or proceedings arising from or related to the Contest/Sweepstakes shall take place in a location determined by Jordan’s Library. This venue ensures efficient handling of legal matters.
Participants who do not reside in the allowable countries (Section 10) may not participate in the Contest/Sweepstakes and are ineligible to win any prizes.
By participating in the Contest/Sweepstakes, participants acknowledge and agree to the following:
22.1. Waiver of Legal Claims: Participants expressly waive their right to initiate or participate in any legal actions, claims, disputes, or lawsuits against Jordan’s Library, its affiliates, employees, agents, representatives, or any other parties associated with the Contest/Sweepstakes, whether arising from or related to participation in the Contest/Sweepstakes or the Contest/Sweepstakes itself.
22.2. Assumption of Responsibility: Participants understand and accept that the Contest/Sweepstakes is offered as a promotional event and entertainment activity. They acknowledge that they are solely responsible for their actions and decisions during the Contest/Sweepstakes.
22.3. Limitation of Liability: Participants release Jordan’s Library and its affiliates (“Released Parties”) from any and all liability, claims, damages, losses, or injuries (including attorney’s fees) resulting from their participation in the Contest/Sweepstakes, acceptance or use of prizes, or any violation of these Terms and Conditions. This includes but is not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Contest or Sweepstakes; (c) printing errors; (d) errors in the administration of the Contest/Sweepstakes or the processing of entries; (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participants participation in the Contest/Sweepstakes or receipt of the Prizes (defined below) or (f) infringement or alleged infringement of a third party’s intellectual property rights or similarly proprietary rights. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participation in this Contest/Sweepstakes or downloading any materials in the Contest/Sweepstakes. Participants further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest/Sweepstakes, and in no event shall the Released Parties be liable for attorney fees. Participants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. For New Jersey Residents: nothing herein bars recovery of damages or attorneys’ fees where mandated by statute.
Except as expressly provided above, IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING FROM, RELATING TO, OR IN CONNECTION WITH THIS CONTEST/SWEEPSTAKES OR ARISING OUT OF PARTICIPATION IN THIS CONTEST/SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE.
By participating, Participants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Contest/Sweepstakes or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of a Prize. Released Parties are not liable in the event that any portion of the Contest/Sweepstakes is cancelled or delayed due to weather, fire, strike, acts of war or terrorism, pandemic, or any other condition beyond their control.
EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE USA ARE HEREBY EXPRESSLY WAIVED BY HIM/HER. SECTION 1542 READS AS FOLLOWS:
“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
23.1. Intellectual Property Rights Waiver: Participants in contests involving intellectual property rights (e.g., art contests, creative submissions) hereby grant Jordan’s Library, its affiliates, successors, and assigns a perpetual, worldwide, royalty-free, non-exclusive, sub-licensable, and transferable license to use, reproduce, distribute, display, and publish their submitted materials (including but not limited to artwork, text, images, and any other creative content) for promotional and marketing purposes related to the Contest/Sweepstakes, without further compensation.
23.2. Non-Exclusive Rights: This license does not restrict participants from using their submitted materials for their own personal or commercial purposes, but it allows Jordan’s Library the right to promote and showcase these materials in connection with the Contest/Sweepstakes.
23.3. Protection of Third-Party Rights: Participants must ensure that their submitted materials do not infringe upon the intellectual property rights, copyrights, trademarks, or any other rights of third parties. Jordan’s Library is not responsible for any legal claims or disputes related to intellectual property infringement arising from participant submissions.
